ASSUMPTION OF RISK & LIABILITY
All Torrent Cycle participants are required to understand and acknowledge our liability waiver prior to participation in any Torrent Cycle activities.
ASSUMPTION OF RISK. I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING IN ANY/ALL ACTIVITIES OR EVENTS ASSOCIATED WITH AND/OR ORGANIZED BY TORRENT CYCLE, LLC, A UTAH LIMITED LIABILITY COMPANY, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault.
PHYSICAL QUALIFICATIONS. I certify that I am physically fit, have sufficiently prepared or trained for participation in this activity, and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in this activity.
ACKNOWLEDGEMENT OF RELEASE. I acknowledge that this Accident Waiver and Release of Liability Form will be used by the event holders, sponsors, and organizers of the activity in which I may participate, and that it will govern my actions and responsibilities at said activity.
RELEASE. In consideration of my application and permitting me to participate in this activity, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:
I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this activity, THE FOLLOWING ENTITIES OR PERSONS: Torrent Cycle, LLC, (“Torrent Cycle”) and/or their directors, officers, employees, volunteers, representatives, and agents, and the activity holders, sponsors, and volunteers;
HOLD HARMLESS AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph from any and all liabilities or negligence claims made as a result of participation in this activity, whether caused by the negligence of release or otherwise.
ACKNOWLEDGEMENT OF THIRD PARTIES. I acknowledge that Torrent Cycle and their directors, officers, volunteers, representatives, and agents are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific activity on their behalf.
ACKNOWLEDGEMENT OF RISKS. I acknowledge that this activity may involve a test of a person's physical and mental limits and carries with it the potential for death, serious injury, and property loss. The risks include, but are not limited to, those caused by facilities, temperature, condition of participants, equipment, lack of hydration, and actions of other people including, but not limited to, participants, volunteers, monitors, and/or producers of the activity. These risks are not only inherent to participants, but are also present for volunteers.
APPLICABLE LAW. Any legal or equitable claim that may arise from participation in the above shall be resolved under Utah law. This Accident Waiver and Release of Liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable Utah law.
CERTIFICATION OF UNDERSTANDING. I CERTIFY THAT I HAVE READ THIS DOCUMENT AND I FULLY UNDERSTAND ITS CONTENT AND HOW IT AFFECTS MY LEGAL RIGHTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.
MEMBERSHIP TERMS
RECURRING MONTHLY CLASS PASS PURCHASES
All recurring monthly class passes are valid at all Torrent Cycle locations.
Class Passes renew automatically each month. Your card on file will be charged automatically each month.
Unused class credits expire at the end of each billing cycle and are not carried over from month to month.
A 2-month minimum commitment is required with each Class Pass purchase.
Cancellation of your monthly pass requires notification before your next billing date via email to frontdesk@torrentcycle.com.
You must cancel your reserved bike at least 12 hours before the start of class in order for your class credit to be added back to your account.
You are permitted two (2) freezes on your account each calendar year. You may freeze your account each time for a maximum of 30 days. Notify the front desk of your requested freeze via email at frontdesk@torrentcycle.com.
ONE-TIME NONRECURRING CLASS PACKAGE PURCHASES
All one-time nonrecurring class packages are valid at all Torrent Cycle locations.
Class Packages are a one-time purchase and will not auto-renew.
Unused class credits expire at the end of the class package’s expiration period.
You must cancel your reserved bike at least 12 hours before the start of class in order for your class to be added back to your account.
YOUR RIGHTS AS A CONSUMER
YOU, THE CONSUMER, MAY CANCEL YOUR PURCHASE OF A RECURRING CLASS PASS OR NON-RECURRING CLASS PACKAGE AT ANY TIME PRIOR TO MIDNIGHT OF THE THIRD BUSINESS DAY AFTER THE DATE OF PURCHASE by sending an email to frontdesk@torrentcycle.com, by sending a written notice to 252 East 300 South, Salt Lake City, UT 84111, or by talking to a front desk representative in the studio.
Torrent Cycle will offer 45-minute classes for the duration of your Class Package or recurring Class Pass. This includes the use of a stationary bike, which you will be assigned upon booking your class. Torrent Cycle reserves the right to change or modify the use of any equipment as it deems necessary.
IN THE EVENT THAT TORRENT CYCLE CLOSES AND ANOTHER FACILITY OPERATED BY TORRENT CYCLE IS NOT AVAILABLE WITHIN A FIVE (5) MILE RADIUS OF THE LOCATION THE MEMBER INTENDS TO PATRONIZE, TORRENT CYCLE WILL REFUND TO MEMBER A PRO-RATA SHARE OF THE MEMBERSHIP COST, BASED UPON THE UNUSED CLASS CREDITS REMAINING ACCORDING TO THE CONTRACT.
We not offer paid-in-full memberships. Monthly recurring Class Passes can only be paid for on a month-to-month basis. Non-recurring Class Packages are paid for upfront and will not be automatically charged. Torrent Cycle does not charge its members down payments, enrollment fees, or membership fees.

We respect consumers’ constitutional rights to privacy and data protection. This Privacy Policy explains how Torrent Cycle (“we/us”) collects, uses and discloses your personal information with respect to your use of our website, www.torrentcycle.com.
We reserve the right to change our Privacy Policy at any time, in which case we will post our amended Privacy Policy on our website.
Definition of Personal Information: “Personal information” means information that specifically identifies an individual (such as a name, address, telephone number and email address), or information about that individual that is directly linked to personally identifiable information. Personal information does not include “aggregate” information, which is data we collect about the use of our websites or about a group or category of services or users, from which individual identities or other personal information has been removed. Opt-Out and Delete Options: You may opt-out of receiving marketing or promotional emails from us by following the unsubscribe instructions in those emails. You may also opt out of marketing emails by updating your user preferences on the appropriate section of our website (if available). Even after you opt out, you may continue to receive marketing and promotional emails from us for a period of time while we process your opt-out request.
